These Terms of Service (“Terms”) govern your use of www.getahana.com and the website, hosting, and optional SEO services provided by Ahana Digital (“Ahana,” “we,” “us”). By using our site, checking out, or continuing as a client, you agree to these Terms.
1. Services
Ahana provides custom website design, hosting, and optional SEO and related marketing services for small businesses, as described on our pricing page. Website plans (Essential, Standard, Professional, Max) and SEO plans (Basic, Enhanced, Premium) are separate products with distinct deliverables and fees.
Website subscriptions typically include hosting, domain registration or management while active, a contact form, and the monthly edit allowance for your plan. Sites are custom-built for each client. Page counts and features are per plan. Setup fees, where applicable, are charged in addition to the monthly subscription.
After launch, edit allowances are: Essential — 1/month; Standard — 2/month; Professional — 3/month; Max — 4/month. Edits cover copy, photos, hours, and similar updates — not new pages unless your plan expressly includes them. Additional work may be quoted separately.
2. Billing & Payment
Plans are billed monthly in advance unless we agree otherwise in writing. You authorize recurring charges to your payment method on file. Failed payments may result in suspension or termination of services, including taking the website offline, until the account is current.
3. Refunds
Refunds are available only if you decline the initial website draft before any draft has been accepted. Once you accept a draft (or approve moving past the initial draft into revisions or launch), no refunds of any kind are owed — including monthly subscription fees, setup fees, or fees for work already performed.
SEO plan fees, add-on fees, and third-party charges (for example domain renewals already paid to a registrar) are non-refundable except where required by law.
4. Price Changes
We may increase subscription or service fees. We will provide written notice at least 90 days before any increase takes effect. By continuing to use the services after that effective date, you agree to the new fees. If you do not agree, you may cancel under these Terms before the increase takes effect; cancellation still follows the intellectual property rules below.
5. Intellectual Property — Websites
All websites, designs, layouts, code, templates, systems, and related materials created by Ahana remain Ahana’s intellectual property. You receive a limited, non-exclusive, non-transferable license to use the live website only while your subscription is active and only under these Terms and any applicable service agreement.
You may not copy, export, republish, resell, transfer to another host, or otherwise use the website (or substantial parts of it) outside the scope of our agreement without our prior written consent.
6. Cancellation & Forfeiture Of The Website
Either party may cancel with 30 days’ written notice unless a separate signed agreement states otherwise.
Cancellation of website services is a forfeiture of the website as Ahana’s intellectual property. When the subscription ends, your license ends. We may take the site offline, remove it from our hosting, and discontinue access. You are not entitled to receive source files, design files, code, or a transferable copy of the site upon cancellation, except where we agree in a separate written transfer agreement.
Domain names registered or managed for you will be handled as stated at signup or in writing; typically, transferable domain registration can be released to you upon request when your account is in good standing, subject to registrar rules and any unpaid fees. Domain ownership is separate from ownership of the website itself.
7. Intellectual Property — SEO & Google Business Profile
Google Business Profile access and assets, and SEO work product delivered to you — including written SEO copy, blog content created for your business, citation listings where transferable, and related client-facing deliverables — are your property (or remain under your control), subject to any third-party platform terms (including Google’s).
Tools, processes, reports formats, automation, prompts, and internal systems we use to produce SEO work remain Ahana’s property. Rankings, traffic, and leads are not guaranteed.
8. SEO Results
SEO results are not guaranteed. Rankings depend on competition, algorithm changes, market conditions, review velocity, your industry, and factors outside our control. We provide professional, ethical optimization — not promises of specific positions, traffic levels, or lead volumes.
9. Client Responsibilities
You agree to provide accurate business information, timely feedback and approvals, and lawful content. You retain responsibility for claims made about your services, pricing, licensing, insurance, and regulatory compliance on your website and marketing materials. You grant Ahana a license to use content you supply solely to deliver the services.
10. Acceptable Use
You may not use our services for unlawful, fraudulent, defamatory, or infringing content, or to distribute malware or spam. We may suspend or terminate services for material breach of these Terms.
11. Limitation Of Liability
To the fullest extent permitted by law, Ahana Digital is not liable for indirect, incidental, special, or consequential damages arising from use of our site or services. Our total liability for any claim is limited to the fees you paid to Ahana in the three (3) months preceding the claim.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except where applicable consumer law requires otherwise.
13. Changes To These Terms
We may update these Terms. Material changes will be posted on this page with an updated date. Continued use of the services after posting constitutes acceptance of the updated Terms, except that fee increases follow the 90-day notice rule in Section 4.
